1. Agreement Overview

This End User Agreement (“Agreement”) is entered into between you (“User”, “you”, or “your”) and Bermax Specialty Underwriters (“Bermax”, “we”, “us”, or “our”).
By accessing, browsing, or using our website, client portal, or services (collectively, “Services”), you acknowledge that you have read, understood, and agree to be bound by this Agreement and all applicable laws and regulations.

If you do not agree with these terms, you must immediately cease use of our Services.

2. Authorized Use

You are granted a limited, non-exclusive, non-transferable, revocable license to:

• Access and use the Services for legitimate business or personal purposes related to obtaining insurance underwriting, claims services, advisory information, or related transactions.

You agree:

• To use the Services only for lawful purposes;

• Not to access (or attempt to access) restricted areas without authorization;

• Not to interfere with the proper working of the Services.

3. User Accounts

If you register for a Bermax client account:

• You must provide accurate, current, and complete information;

• You are responsible for maintaining the confidentiality of your login credentials;

• You accept full responsibility for any activities that occur under your account.

Bermax reserves the right to suspend or terminate any user account found to be in violation of this Agreement.

4. Ownership and Intellectual Property

All intellectual property rights in the Services, including but not limited to text, software, graphics, logos, and documentation, are owned by Bermax or licensed to us.

You may not:

• Copy, modify, distribute, sell, lease, or create derivative works based on any portion of the Services.

• Use Bermax’s trademarks without prior written consent.

5. Data Protection

Use of our Services is subject to our Privacy Policy, which outlines how we collect, use, and protect your personal information.
By using the Services, you consent to the processing of your personal data in accordance with our Privacy Policy.

6. Confidentiality

In the course of using our Services, you may gain access to confidential or proprietary information belonging to Bermax or third parties.

You agree:

• To maintain the confidentiality of such information;

• Not to disclose it to any third party without prior written authorization;

• Not to use it for any purpose other than the intended use of the Services.

7. Disclaimers

The Services are provided “as is” and “as available,” without warranties of any kind, either express or implied.
Bermax disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee:

• That the Services will meet your requirements;

• That the Services will be uninterrupted, timely, secure, or error-free;

• That any information obtained through the Services will be accurate or reliable.

8. Limitation of Liability

To the fullest extent permitted by law, Bermax shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or relating to:

• Your access to or use of (or inability to access or use) the Services;

• Unauthorized access, alteration, or loss of your transmissions or data.

Our total cumulative liability under this Agreement shall not exceed AED 1,000 or the amount you have paid for the Services in the twelve (12) months preceding the event giving rise to the claim, whichever is greater.

9. Termination

Bermax may, at its sole discretion, suspend or terminate your access to the Services without notice if you violate this Agreement or applicable laws.

Upon termination:

• Your rights to use the Services will immediately cease;

• Provisions regarding ownership, confidentiality, limitations of liability, and governing law shall survive termination.

10. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with:

• The laws of the Dubai International Financial Centre (DIFC), United Arab Emirates.

Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the Courts of the DIFC.

11. Modifications

Bermax reserves the right to amend or update this Agreement at any time without prior notice.
Revised versions will be posted on our website, and continued use of the Services after changes constitutes your acceptance of the revised Agreement.
